The appellant, Dr. P. E. Marks, is Superintendent of the Bureau of Infectious Diseases of the City of Pittsburgh. In an action of assumpsit, brought by a beneficiary under a life insurance policy, pending in the County Court of Allegheny County, he was served by the insurance company defendant with a subpoena duces tecum requiring him to produce the records of his department or bureau relative to Martin Weitzel, the assured in said policy. • Dr. Marks appeared in court pursuant to the subpoena, but, on the advice of the City Solicitor, refused to produce the ‘records’…
