Plaintiff, a resident of The Bronx and the father of two children attending a public school maintained by the Board of Education, sues the defendants State of New *325York, the City of New York, and others, on his own behalf and on behalf of those similarly situated, for a declaratory judgment declaring subdivision 2 of section 2553 of the Education Law unconstitutional.
