ORDER GRANTING PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

This case arises out of a foreclosure action of a mortgage by Plaintiff Federal Deposit Insurance Corporation (hereinafter “FDIC”) against Defendant Bandon Associates (hereinafter “Defendant” or “Associates”). 1 The case involves the claim of Plaintiff FDIC for payment of a promissory note (hereinafter “Note”) and foreclosure of a mortgage and sale of property in accordance with Title 14 M.R.S.A. section 6321 et seq.
