The plaintiff is Qwest Communications International, Inc., a Delaware corporation (“Qwest”). Qwest brings this action to enjoin the defendants, who are a number of its insurance carriers, from circumventing insurance policy provisions that, it claims, gives Qwest the right to choose the form of alternative dispute resolution (“ADR”)-mediation or arbitration-to resolve coverage disputes.
