The defendant Moody, wishing to buy a house owned by a Mrs. Glazier for less than it was offered to him by. the plaintiff corporation (which had it for sale for the owner), asked the defendant Wheelock (a real estate broker who had no office but did business at the house where he lived) to get the house for him for the lowest price at which it could be bought. Thereupon Wheelock saw Mrs. Glazier’s son (who acted for his mother throughout) and told him that he could sell the house for him if he would employ him as his broker.
