MEMORANDUM

EDGAR, District Judge.

Defendant Michael Crowder (“Crowder”) has made a motion for post-conviction relief pursuant to 28 U.S.C. § 2255. He contends that his judgment of conviction and sentence under Count 2 of the indictment for violating 18 U.S.C. § 924(c)(1) should be vacated and set aside in light of the Supreme Court’s decision in Bailey v. United States, — U.S. -, 116 S.Ct. 501, 133 L.Ed.2d 472 (1995).
