I. INTRODUCTION

On December 2, 1996, plaintiff The Dow Chemical Company (“Dow”) filed this action against defendants Exxon Corp. and Exxon Chemical Patents, Inc. (“ECPI”) (collectively “Exxon”), alleging violations of the federal Racketeer Influenced and Corrupt Organizations Act (“RICO”), 18 U.S.C. § 1961 et seq., and state law.
