PISANO, District Judge.

INTRODUCTION

As the largest nineteenth century beachfront hotel remaining in the City of Cape May (“City” or “Cape May”), New Jersey, the Congress Hall Hotel (“Hotel”) is a National Historic Landmark. Congress Hall Partners, LLC (“CHP”), the current owner of the Hotel, seeks to restore the Hotel and to construct a new conference center adjacent to the existing structure.
