Liberty Mortgage Corp. (“Liberty” or “plaintiff’), brought suit against the Federal Home Loan Mortgage Corp. (“Freddie Mac” or “defendant”) alleging that Freddie Mac violated its due process rights under the Fifth Amendment of the Constitution when it terminated Liberty’s service agreement. Plaintiff also brought suit against Freddie Mac under 42 U.S.C. § 1983 and the New York state constitution alleging that Freddie Mac violated Liberty’s due process rights when it seized Liberty’s servicing portfolio pursuant to state sanctioned U.C.C. procedures.
