The defendant, Jose Padilla, was convicted in a trial without a jury of the murder of Donald Bogseth. He was sentenced to 30 to 60 years imprisonment. On appeal, he contends that the court erred in denying his motion to suppress inculpatory statements he made, asserting that the statements resulted from an illegal arrest and were made by him without a knowing and intelligent waiver of his privilege against self-incrimination and his right to counsel.
