1Opinion of the CourtSchottky, J.
Robert Volk was found guilty by a jury of the crime of robbery in the first degree. His motion for a new trial was denied and he has appealed from the judgment and from the order denying his motion for a new trial. The order being nonappealable the purported appeal therefrom is hereby dismissed.
Appellant does not attack the sufficiency of the evidence to support the judgment so it is unnecessary to detail the evidence. Appellant does, however, make a vigorous attack on the admission into evidence of the testimony of Joyce Volk, also known by other names, given at the preliminary examina tion.…
