Appeal hy the defendant, The United States Transportation Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of LTew York on the 22d day of April, 1910, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 29th day of April, 1910, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff is a real estate broker, and he brought this action to recover commissions for sub-leasing for the defendant pier No. 84 and bulkhead, North river, situate at the foot of "West Forty-fourth street, borough of Manhattan, New York. He claims to have been employed as a broker for this purpose on the 21st day of November, 1907, by one Bobert C. Scholz, an employee of the defendant, whose position was designated general manager.
