ORDER

STORY, District Judge.

This case comes before the Court on the Southern Company Defendants’ Motion to Dismiss Plaintiffs Amended Complaint [27] and Plaintiffs Motion for Leave to File Supplemental Brief [58]. 1 Plaintiffs Motion for Leave to File Supplemental Brief [58] is GRANTED nunc pro tunc. For the reasons that follow, the Southern Company Defendants’ Motion to Dismiss [27] is GRANTED in part and DENIED in part.
