OPINION
SWEET, District Judge.
This is an action brought by the plaintiff pro se Mario Herrera (“Herrera”) pursuant to the Civil Rights Act of 1871, 42 U.S.C. §§ 1983 and. 1985, against defendants Charles J. Scully, Charles R. Winch, Robert J. Seitz, John Johnson, Edgar Maldonado, Patricia Miller, and Pat Raimo (collectively, the “Defendants”), each of whom was employed at the Green Haven Correctional Facility (“Green Haven”) in Stormville, New York during 1987.
