“ Ernst Meyer, plaintiff, complains of Mary A. Vail and John B. Vail, her husband, Francis Adkinson and Mayer Rothschild, defendants, and says, that heretofore, to wit, on the — day of J une, 1874, the plaintiff’ made a contract *161with said defendant Mary A.
