Appeal by the defendant from a judgment of the Supreme Court, Queens County (Joy, J.), rendered May 18, 1989, convicting him of criminal sale of a controlled substance in the third degree, upon a jury verdict, and imposing sentence, and an amended judgment of the same court, also rendered May 18, 1989, revoking a sentence of probation imposed by the same court upon a finding that he *817had violated a condition thereof, and imposing a sentence of imprisonment upon his prior conviction of criminal sale of a controlled substance in the fifth degree.
