This appeal challenges certain regulations promulgated by the Secretary of Agriculture (the Secretary). The regulations prohibit the sale of soda water (soda pop), water ices, chewing gum, and certain candies, throughout the public schools where Federally subsidized breakfast and lunch programs are authorized.
