Plaintiffs, the Estate of Eddie Colon, Luz Abby Colon, Eddie Colon Sanchez and Nancy Jurado Sanchez (hereinafter collectively “plaintiffs”), filed this suit as Eddie Colon’s (“Colon”) next of kin because of his death while he was incarcerated at a Puer-to Rico state prison. Plaintiffs brought this action pursuant to 42 U.S.C. § 1983 alleging constitutional rights violations, as well as state law claims of negligence under Article 1802 of the Civil Code of Puer-to Rico, P.R.
