MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

On November 26, 2000, a jury returned a verdict in favor of plaintiff Safety Technologies, L.C. (“Safety Technologies”) against defendant Biotronix 2000, Inc. (“Biotronix 2000”) for $45,733 in damages and found that the plaintiff was also entitled to an award of punitive damages. On February 5, 2001, this court held a hearing to set punitive damages, as directed by K.S.A. § 60-3702, and to hear argument on the defendant’s motion for judgment as a matter of law. 1 For the reasons set out below, the defendant’s motion for judgment as a matter of law…
