SEYMOUR, Chief Judge.

This civil rights lawsuit stems from the shooting of an unarmed motorist by an off-duty police officer. After settling with the officer, the motorist, Clinton Brown, filed a lawsuit against Denver under 42 U.S.C. § 1983. Denver appeals the denial of its motions for judgment as a matter of law and for a new trial following an adverse jury verdict. Mr. Brown cross-appeals the district court’s refusal to grant his motion for judgment on a cross-claim assigned to him by the officer, and the court’s failure to award him certain out-of-pocket expenses as attorney’s fees.
