On August 27, 1997, plaintiff Paul James (“James”), a Canadian citizen and resident of Ontario, brought this diversity action against defendants Arthur DeGrandis (“Mr. DeGrandis”) and Mark DeGrandis (“Mark”), residents of New Jersey, and Mary Kate Nugent (“Nugent”) and Christopher Conklin (“Gonklin”), residents of New York.
