KAUFMAN, J.

In 1973 a jury convicted petitioner of kidnaping (Pen. Code, § 207) and rape by threat of force (Pen. Code, § 261, subd. 3) and found he was armed with and used a firearm in connection with each offense. The judgment of conviction was affirmed on appeal by this court in an unpublished opinion (4 Crim. 6056). Petitioner, who is presently confined in state prison seeks habeas corpus on grounds of newly discovered evidence and false testimony by the principal prosecution witness.
