WERDEGAR, J.

Following a mistrial declared when a jury was unable to agree on guilt, a second jury convicted defendant George Edward Marshall of three counts of first degree murder (Pen. Code, § 187; all further statutory references are to the Penal Code unless otherwise indicated) and one count of attempted murder (§§ 664/187), and as to each count found defendant used a firearm during the commission of the offense (§ 12022.5).
