ROSENN, Circuit Judge.

Pennsylvania enacted the Motor Vehicle Financial Responsibility Law (the Act), of which § 1722 precludes a person from recovering damages arising out of the use of a motor vehicle from a culpable tortfeasor if the claimant is otherwise eligible to receive those benefits from any program, group contract, or other arrangement, as defined by the Act. 75 Pa.' Cons.Stat.Ann. § 1722 (Supp.1993). The primary issue raised on this appeal is whether the Act is preempted by the Employee Retirement Income Security Act of 1974, (ERISA), 29 U.S.C. § 1001 et seq.…
