MUNGER, District Judge.

This was an action at law for damages for breach of a contract. The trial court directed a verdict against the plaintiff and dismissed his action, and he has appealed. In his petition the plaintiff alleged that he had been employed at Grand Forks, N. D., by the defendant telephone company as a repairer of its lines from April 20, 1910, until December 4, 1930, when he was discharged. He alleged that the discharge was wrongful because he had an agreement with the defendant for employment during his life, and that the discharge was without cause. In averring his contract…
