In this case the defendant was convicted of murder in the first degree, and appeals.

The affair grew out of the attempt of some young men to steal a slot machine. The deceased was a man by the name of Ho.ag, who operated a filling station and a small store on the outskirts. of Osawatomie. The dwelling house in which' he lived with his sister was close by the filling station and store.- Jack Brunts, Edward Higgins, Don Bundy and Alvie Baffrey were all young men who-lived in Osawatomie.
