This is an appeal from an order granting Ronald Lam’s petition for a writ of habeas corpus under 28 U.S.C. § 2254. Lam was found guilty on two counts of second degree burglary in Iowa state court, and was sentenced as a habitual offender to 30 years’ imprisonment. The district court found that the admission into evidence of a videotaped deposition of the owner of the stolen property, who did not personally appear at trial, violated Lam’s sixth amendment right of confrontation and that the error was not harmless.
