Appeal by the plaintiff, Benjamin M. Thompson, as assignee for the benefit of creditors of the Metropolitan Messenger Company, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 5th day of February, 1902, upon the dismissal of the complaint by direction of the court after a trial at the New York Trial Term.

The plaintiff, as assignee for the benefit of creditors of the Metropolitan Messenger Company, sues to recover from the defendant the amount unpaid on certain stock of the plaintiff’s assignor issued to the defendant, alleging that there is unpaid on said stock the sum of $2,800. The. complaint alleges that the corporation issued to the defendant in April and May, 1898, sixty shares of stock of the' par value of $6,000, and that he in consideration therefor paid to the company the sum of $3,200; that the said defendant has never paid any further or other sum in consideration of…
