This case presents error from the district court of Rogers county, and was an action of ejectment brought under the laws in force in the Indian Territory prior to statehood. The defendant in error, as plaintiff in the ■ court below, brought her action to recover the possession of a strip of land twenty-five feet wide, running through a tract of land which was allotted to her as a member of the Cherokee Tribe of Indians.
