The defendant, Wyatt Michael Rose, was charged in the district court for Douglas County with the crime of burglary. The defendant was arraigned on December 5, 1967, and, with the assistance of legal counsel, entered a plea of guilty. Sentence was deferred pending a pre sentence investigation and on April 16, 1968, defendant was sentenced to the Nebraska Penal and Correctional Complex for a period of not less than 2 years nor more than 3 years. The defendant has appealed to this court.
