WILKINS, Associate Presiding Judge:

The Utah Board of Pardons (the Board) appeals the trial court’s order partially *148granting Stacy Ray Peterson’s amended petition for extraordinary relief. Peterson cross-appeals the portion of that order denying him a new, plenary hearing. We reverse.

BACKGROUND

Peterson pleaded guilty in March 1989 to second degree murder and was sentenced to serve a term of five years to life, with an additional five-year firearm enhancement, at the Utah State Prison.
