This matter involves an Emergency Petition for Writ of Mandamus, filed by the Department of Justice on behalf of the Executive Office of the President (“EOP”), challenging a discovery order by the District Court.

The underlying law suit is a civil action brought by plaintiffs who claim inter alia that the FBI improperly gave the White House FBI files of former political appointees, and that the White House improperly maintained those files, in violation of the Privacy Act, 5 U.S.C. § 552a (1994).
