ERROR to the Rush Circuit Court.

1Opinion of the CourtDewey, J.

— Ejectment on the demise of Moore and wife against Abernathy for a quarter section of land. Plea, not guilty. An agreed case presents the following facts, viz.:

Samuel Ross, a citizen of Pennsylvania, was the patentee of the land in controversy; he died in 1821, on a journey commenced for the purpose of removal to this state, intestate, arid without issue, leaving his mother and eight brothers and sisters of the full blood, and four of the half-blood, the latter having a different mother from the former; his mother and two of his brothers of the full blood (the latter leaving no issue) died…
