Appeal by the defendants, John T. Cade and another, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Erie on the 25tli day of February, 1907, upon the decision of the court rendered after a trial at the Erie Special Term.

The judgment should be affirmed, with costs.
The action was brought for relief in the nature of specific performance of a contract made by the Standard Railroad Signal Company, a New Jersey corporation, with the plaintiff’s assignor, a New York corporation. There seems to be no controversy here as to the facts. The making of the contract, the liability of the New Jersey corporation to perform the same, and the plaintiff’s interest therein are not disputed.
