KNIGHT, Justice.

This is an appeal by the appellant from a judgment of the circuit court of Mobile county, awarding the plaintiff damages in the sum of $4,659.88.

The plaintiff stated his cause of action against the defendant in eight counts. The first six are common counts. In count 7, the plaintiff sought to recover of the defendant $2,412.21, alleged to be due from the defendant to plaintiff “for money heretofore wrongfully collected by the defendant from plaintiff as a tax of one cent per gallon on 241,-221 gallons of gasoline purchased by plaintiff of defendant, said sum having been…
