OPINION

JAMES M. CARTER, Circuit Judge:

In No. 71-2058, appellants Mayview Corporation et al. (hereafter Mayview) contest a preliminary injunction granted *716by the district court to appellees Harvey B. Rodstein, et al. (hereafter Rodstein) on May 25, 1971. The injunction prohibited Mayview from infringing Rod-stein’s patent No. 3,563,134 and trademark “RODAC,” No. 903,459. The question is whether the trial court applied the proper standard for grant or refusal of a preliminary injunction. We reverse.
