MEMORANDUM OPINION AND ORDER 1
CHAMBERS, District Judge.
Darrell B. Zickafoose (“Plaintiff’) initially filed a complaint in the Circuit Court of Mason County, West Virginia in which he alleged that his former employer committed violations of the Americans with Disabilities Act of 1990 (“ADA”), the Consolidated Omnibus Budget Reconciliation Act (“COBRA”) and West Virginia common law. UB Services, Inc., a division of Concorp, Inc., (collectively “Defendants”) removed the case to this Court pursuant to federal question jurisdiction.
