Tbe petitioner Sundfor, tbe attorney general consenting, applied to this court for an original writ to restrain tbe respondent Herman Thorson, tbe secretary of state, from certifying tbe name of Charles R. Robertson as an individual nominee for tbe office of Representative in Congress to be printed on the ballot to be voted upon at tbe general election on November 3, 1942; and to restrain tbe respondent Scblenker, as county auditor of Burleigh county, from having Robertson’s name printed on said ballot.
