We grant the Flores family’s motion for rehearing. We withdraw our opinion dated July 1, 1999, and substitute the following in its place.

This case concerns the exclusion of an expert witness’s testimony for violating “the Rule”1 by discussing the case with a corporate representative. In addition, we clarify the proper procedure for applying settlement credits under Chapter 33 of the Civil Practice and Remedies Code when all of the plaintiffs are seeking damages for injury to the same person.…
