This action was commenced in March, 1935, in the district court of Union County, in which plaintiff sought to 'recover $2,500 actual damage and $2,500 exemplary damage from the defendant by reason of the alleged false and malicious arrest and prosecution of the plaintiff by defendant. At the close of plaintiff’s evidence a motion for a directed verdict made by the defendant was overruled by the court and at the close of all of the evidence the motion was renewed and was sustained by the court and a verdict was returned for the defendant under the ruling and direction of the trial court, and…
