In 1971 Gregory was sentenced to twenty-five years imprisonment for two separate narcotics violations — conspiracy to violate the narcotics laws and sale of narcotics. On September 19, 1977 he filed a motion under 28 U.S.C. § 2255 to have that sentence vacated. His motion alleged that his sentence was predicated on a constitutionally erroneous presentence investigation report, that he was denied effective assistance of counsel at sentencing because this report was not made available to him, and that the twenty-five year sentence was so severe in contrast to…
