We granted permission to appeal in this case pursuant to Rule 11 of the Tennessee Rules of Appellate Procedure to determine whether the Court of Criminal Appeals erred in vacating the defendant’s conviction. The defendant, Thomas Poston Studdard, was indicted for three counts of rape of a child.
