Nancy Gillis sued her physician (and his professional association) and James Goodgame, a radiological physicist, alleging defendants administered unnecessary radiation therapy to her after surgery for breast cancer. The affidavit of an expert witness was filed contemporaneously with the complaint, under OCGA § 9-11-9.1, but the affidavit addressed only the alleged professional negligence of the physician. Defendant Goodgame brought a motion to dismiss the claim against him, or in the alternative to grant summary judgment in his favor. His basis was that the services he rendered…
