This is a suit for damages for personal injuries instituted in the district court of Potter county by appellee Taylor against the appellant, the United States Express Company, in the trial of which verdict and judgment were rendered upon appellee's third amended original petition, in which it was alleged in substance: That one of the drivers of appellant's teams, hitched to one of its express wagons, while on one of the main streets of Amarillo, negligently "popped" a large whip in an unusual, loud, and reckless manner, "stamped" his feet on the boards of said express wagon (and other…
