It is alleged substantially, and admitted in the pleadings, that on the 30th day of May, 1914, the appellee, Page, was employed by the Texas & Pacific Railway Company, as a flagman, and as such it was his duty to keep a lookout for travelers on St. Paul street, in the city of Dallas, approaching the crossing of the railroad track along Pacific avenue, and to keep a lookout for trains and warn travelers seeking to use the crossing of the approach’of trains.
