On October 7, 1932, the plaintiff in error, hereinafter called the petitioner, was indicted for murder in the second degree and pleaded not guilty. On October 25 he was put to trial before a jury in the Superior Court and was found guilty. He was sentenced to imprisonment for life —• the punishment prescribed by our statute for the offence charged. G. L. (Ter. Ed.) c. 265, § 2. Nearly sixteen years later, on July 2, 1948, he sued out his writ of error in this court, assigning as error that he was tried without the benefit of counsel in violation of his rights under art. 12 of the Declaration…
