This is an action for damages for alleged fraud and deceit in connection with the sale and delivery of a specimen or sample policy of life, health, and accident insurance to the plaintiff by one J. S. Orr, agent of the defendant company. At the trial of the case, the defendant by its answer having offered to allow judgment in favor of the plaintiff for actual damages, it was agreed that such damages amounted to $30, and that a verdict therefor should be rendered for the plaintiff.
