This matter is before the Court on the first and second affirmative defenses of the defendants’ answer to the plaintiff’s pro se complaint, which the Court shall treat as a motion to dismiss for lack of subject matter jurisdiction, pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure; and the defendants’ motion for summary judgment as to the jurisdictional defenses. 1 For reasons set forth below, the Court agrees with the defendants (hereinafter “the State”) that it has no jurisdiction over this cause, and accordingly the…
