Plaintiff, a New York corporation, filed a complaint alleging that defendant, a New Hampshire corporation, is guilty of acts of unfair competition and trademark infringement. Defendant moved to dismiss the complaint on the grounds of lack of jurisdiction, improper venue and insufficiency of service of process. Initially, this court felt inclined to grant the motion insofar as plaintiff had submitted a dearth of proof on the jurisdiction issue.
