|, Ronald Brooks and Jennifer Chavis, the parents of two minors who drowned in a residential pond, individually brought wrongful death and survival actions against the property owners, John and Paulette Sibille, and their insurer. After the cases were consolidated, the defendants filed a motion for summary judgment, arguing that the plaintiffs failed to establish the element of duty or that the pond constituted an attractive nuisance.
